MS. LAVECCHIA: Medical malpractice is medical negligence. It's by someone who is usually a license health care provider. It's failure to act as the prudent medical professional would, whether it's a doctor or a nurse, failure to act as a reasonably prudent doctor or nurse would have acted under similar circumstances. And it can be not only actions, but it can be a failure to act.
Medical malpractice can be very devastating to not only the patient, but to the patients' families. Some of the saddest cases that I've ever handled have been for parents who have lost a child due to medical malpractice. Sometimes, their life comes to a standstill, it seems like.
Anyone who thinks he or she is a victim of medical malpractice should contact an attorney who's experience in these matters, to sit down with them, and to take a look at their set of facts, and to help them in understanding of what the applicable law is.
