Video Surveillance in Nursing Homes

I just learned that a delegate in the Nevada legislature has introduced a bill to permit surveillance in nursing homes.  The bill was prompted by outrageous cases of abuse and neglect of patients including stuffing a diaper in the mouth of a patient.  I've commented on the use of "granny cams" in previous posts.  In the past I've commented that I'm on the fence about whether they should be used because of concerns of privacy of nursing home patients who lack the capacity to consent to video surveillance.  However, the longer I have been litigating nursing home abuse and neglect cases in Virginia the more I feel that families need tools like surveillance to protect their loved ones.

I believe it boils down to lobbying power. The nursing home industry spends heavily to lobby the state legislatures and Congress. Nursing home patients can not speak for themselves. It takes long term care ombudsmen like you and families willing to take legal action in order to stop the abuse and neglect of nursing home patients.

I am a Long Term Care Ombudsman in Illinois. I am not sure of my feelings on this matter but I am extremely upset about the final sentence in the article. 'Another change would release the facility from liability arising from any issues involving the monitoring device.' Why do states continue to allow nursing homes to get away with not protecting our elderly?
