
Nursing homes have a duty to protect their residents from abuse including abuse by other patients. A Cornell University study found that "resident on resident" abuse is far too common in nursing homes. The study identified 35 different types of abuse. The most common was verbal abuse which can cause emotional scarring. Other patients suffered physical abuse. Even sexual assaults in a nursing home are not unheard of.
Nursing home patients are particularly vulnerable to abuse. First, due to their health and age they often lack the physical strength to protect themselves. Secondly, nursing home patients suffering from dementia may not have the ability to call for help. Thirdly, nursing home patients are in close confines (roommates) with their fellow patients which creates an environment for tempers to flare. Lastly, other patients' health may make them prone to engaging in anti-social behavior.
